Tallac Try Now Program Terms and Conditions

 

• The Try Now trial evaluation will be a free trial evaluation of the Tallac SD-Branch solution and will be for a period of 30 days starting from the date when the customer activates the device on the Tallac cloud;  Any extension of the trial period must be agreed in writing by Tallac and the customer prior to the 30 day completion of the product trial to extend the free evaluation period.

 

• Customer/evaluator agrees to Tallac cloud terms upon activation/connection to the Tallac cloud for the trial period

 

• The trial product is available on an As-is trial basis for use during the trial evaluation period;  This  is a limited, personal, non-exclusive, non-transferable non-sublicense license and is for non-production evaluation purposes only (not for commercial purpose)

 

• The customer/evaluator is not granted any rights in the product other than the limited use license

 

• Any proprietary information learned as a result of the trial shall remain a confidential trade secret of Tallac Networks subject to copyright and other intellectual property laws of the US and International treaties

 

• Use restrictions for the trial: the customer/evaluation cannot copy, reproduce, modify, create derivative works, rent, lease, distribute or transfer any rights to the software

 

• Termination/Return: Either Tallac Networks or the customer/evaluator can terminate the agreement for any reason with at least 10 days prior written notice; The Try Now SD-Branch product must be returned within 30 days from the end of the evaluation period (in usable good condition). The product shall be returned at customer’s expense. If the product is not returned within the 30 day return period, the customer/evaluator agrees to pay Tallac Networks for the product within 15 days of delivery of invoice at the end of evaluation period at Tallac Network’s then current list price.

• The Try Now SD-Branch product cannot be used by a third-party or shipped out of the United States or Canada

• Product improvement program: By participating in the Tallac Try Now Program you agree to participate in Tallac Network’s product improvement program – The Tallac Cloud will collect data relating to usage so Tallac Networks can analyze data.

• Entire agreement; The terms outlined in the Tallac Try Now Program are the entire agreement for the Try Now Program and are construed and enforced in all respects in accordance with the laws of California.
